Welcome to TrackTECH! The terms “we,” “us,” and “our” refer to TrackTECH Equipment Solutions LLC (“TrackTECH”). We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Return & Refund Policy), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your jurisdiction and you consent to allow your minor dependents to use the Services on devices you own or manage.
To use the Services (including browsing or purchasing), you may be asked for information such as email, billing, payment, and shipping details. You represent and warrant that all information you provide is current, complete, and accurate, and that you have the rights to provide it.
You are responsible for maintaining the security of your credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

2. OUR PRODUCTS

We strive to represent products accurately; however, colors and appearance may vary due to device settings and configurations. We do not warrant that product appearance, quality, or performance will meet your expectations.
Product descriptions, specifications, availability, and pricing may change at any time without notice. We may discontinue products or limit quantities to any person, region, or jurisdiction.

3. ORDERS

When you place an order, you make an offer to purchase. TrackTECH may accept or decline any order at its discretion. Your order is accepted only when TrackTECH confirms acceptance and processes payment. Review orders carefully before submitting; cancellation requests may not be possible once accepted. If we decline or change an order, we will attempt to notify you at the email, billing address, or phone number you provided.
Your purchases are subject to our Return & Refund Policy. You represent and warrant that purchases are for your own use and not for commercial resale or export.

4. PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of purchase and appears in your order confirmation. Unless expressly stated, posted prices exclude taxes, shipping/handling, customs, and import charges.
Prices on our website may differ from prices offered elsewhere. Promotions may have separate terms; if a conflict arises, the promotion terms govern.
You agree to provide current and accurate purchase and account information and to promptly update payment details and contact information. You represent and warrant that: (i) the payment information you provide is true and complete; (ii) you are authorized to use the payment method; (iii) charges will be honored by your payment provider; and (iv) you will pay all charges including taxes and shipping.

5. SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, or events outside our control. Title and risk of loss pass to you when we transfer products to the carrier.
Most orders arrive within 1–3 business days depending on location and carrier availability. For freight shipments, you must inspect deliveries and note any visible damage/shortage on the Bill of Lading at delivery. See our Freight Receiving Instructions for details.

6. INTELLECTUAL PROPERTY

The Services and all content (including trademarks, brands, text, images, graphics, video, audio, design, selection, and arrangement) are owned by TrackTECH, its affiliates, or licensors, and protected by U.S. and foreign IP laws.
You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works, publicly display/perform, republish, download, store, or transmit any material from the Services without our prior written consent, except as permitted by law.
TrackTECH names, logos, product names, and slogans are trademarks of TrackTECH or its affiliates/licensors. Shopify’s names and marks are trademarks of Shopify. All other marks belong to their owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsement. We have no control over such tools and accept no liability arising from your use. Use them at your own risk and review the third party’s terms.

8. THIRD-PARTY LINKS

The Services may contain links or embedded functionality from third parties. If you access third-party sites, you do so at your own risk. We are not responsible for content, accuracy, policies, or transactions on third-party sites. Review their terms and policies before engaging.

9. RELATIONSHIP WITH SHOPIFY

Note: This section characterizes Shopify’s role and should not be removed.
Our store is powered by Shopify. However, sales and purchases are between you and TrackTECH. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and TrackTECH and you release Shopify and its affiliates from all claims arising out of such transactions.

10. PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy (and certain data may be subject to Shopify’s Privacy Policy). Because the Services are hosted by Shopify, information you submit may be transmitted to and processed by Shopify and third parties (which may reside outside your country) to provide and improve the Services.

11. FEEDBACK

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant TrackTECH a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any lawful purpose. You represent and warrant you own or control the rights to your Feedback and that it complies with these Terms. We may (but are not obligated to) monitor, edit, or remove Feedback we determine to be unlawful, offensive, infringing, or otherwise objectionable.

12. ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, offers, shipping, transit times, and availability. We reserve the right to correct, change, or update information or cancel orders if any information is inaccurate at any time without prior notice (including after submission).

13. PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to, directly or indirectly:

  • Violate laws or third-party rights;

  • Infringe IP, harass, defame, threaten, abuse, or harm;

  • Transmit false/misleading information, spam, or malicious code;

  • Impersonate others or misrepresent your identity;

  • Scrape, crawl, spider, or collect others’ personal information;

  • Reproduce, duplicate, copy, sell, resell, or exploit the Services;

  • Interfere with or bypass security features.
    We may suspend, disable, or terminate accounts for violations.

14. TERMINATION

We may terminate your access to the Services (in whole or part) at any time without notice, and you remain liable for amounts due up to the termination date. Sections that by nature survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will continue to apply.

15. DISCLAIMER OF WARRANTIES

The Services and all products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage. We do not guarantee uninterrupted, timely, secure, or error-free Service, or that content will be accurate or reliable. Some jurisdictions do not allow certain disclaimers; in such cases, the above applies to the fullest extent permitted by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event shall TrackTECH, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, revenue, savings, data, replacement costs, downtime, or business interruption, arising from or related to your use of the Services or products, even if advised of the possibility. Our aggregate liability to you for all claims shall not exceed the amount you paid, if any, for the product or Service giving rise to the claim.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TrackTECH, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your breach of these Terms or incorporated policies; (2) your violation of law or third-party rights; or (3) your use of the Services. We may control the defense and settlement of any matter subject to indemnification; you will cooperate fully.

18. SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, such provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

19. WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and TrackTECH regarding the Services and supersede prior agreements or communications. Any ambiguities shall not be construed against the drafting party.

20. ASSIGNMENT

You may not assign, transfer, or delegate these Terms without our prior written consent; any attempted assignment is void. We may assign, transfer, or delegate these Terms without notice or consent.

21. GOVERNING LAW; VENUE

These Terms and any separate agreements for Services are governed by the laws of the State where TrackTECH is headquartered (USA), without regard to conflict-of-laws principles. You and TrackTECH consent to venue and personal jurisdiction in the state and federal courts of that jurisdiction.

Headings are for convenience only and do not affect interpretation.

23. CHANGES TO TERMS

You can review the most current version of the Terms at any time on this page. We may update or change these Terms at our discretion by posting updates to the website. We will notify you of material changes as required by law. Your continued use of the Services after changes constitutes acceptance.

Trademark Disclaimer

All product names, logos, and brands mentioned on this website are the property of their respective owners. Caterpillar, Bobcat, John Deere, Kubota, Komatsu, and all other brand names or logos referenced are registered trademarks of their parent companies.
TrackTECH is not affiliated with, authorized by, or endorsed by Caterpillar Inc., Bobcat Company, John Deere, Kubota, Komatsu, or any other original equipment manufacturer (OEM).
Any references to brand names, machine models, or logos are for identification and fitment purposes only. Our products are aftermarket replacement parts and are not genuine OEM parts unless explicitly stated.

Fitment Disclaimer

TrackTECH strives to provide accurate product descriptions, fitment information, and specifications; however, equipment models can vary. Customers are responsible for confirming exact machine submodel and track size before ordering.

Warranty Disclaimer

TrackTECH heavy-duty aftermarket rubber tracks include an 18–month warranty depending on product line. This warranty applies only to TrackTECH products and does not extend to OEM parts or competitor brands. See our warranty terms for details and exclusions.

Limitation of Liability (Products)

TrackTECH will not be liable for damages, downtime, or costs caused by incorrect product selection, improper installation, misuse, overloading, or operation outside manufacturer specifications. Always verify fitment prior to installation.
